Terms of Service

Welcome to Xylingo. We have built this platform because we genuinely believe that learning a language should feel natural, immersive, and enjoyable — not like grinding through flashcards.

We are committed to providing you with the best possible experience and continuously improving our product. At the same time, these Terms of Service ("Terms") exist to set clear expectations and protect both you and Xylingo so that we can keep the service running for everyone.

By accessing or using Xylingo (the "Service", "Platform", or "App") — including any website, mobile application, browser extension, or other interface operated by Xylingo — you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1 Definitions

"Xylingo", "we", "us", "our" Refers to the operators of the Xylingo platform and service.

"User", "you", "your" Refers to any individual who accesses or uses the Service.

"Content" Means any text, vocabulary, messages, audio, images, or other material submitted to or generated by the Service.

"AI Features" Means any functionality powered by artificial intelligence or large language models, including but not limited to adaptive news feeds, contextual chats, phrasing suggestions, and calque analysis.

"Subscription" Means a paid plan that grants access to premium features of the Service.

2 Acceptance of Terms

These Terms constitute a legally binding agreement between you and Xylingo. By creating an account, accessing the Service, or clicking any "I Agree" or equivalent button, you represent that: (a) you have read and understood these Terms; (b) you have the legal capacity to enter into this agreement; and (c) you agree to comply with these Terms and all applicable laws.

We reserve the right to modify these Terms at any time. When material changes are made, we will make reasonable efforts to notify you via email, in-app notification, or by updating the "Last Updated" date at the top of this document. Continued use of the Service after any modification constitutes your acceptance of the updated Terms. It is your responsibility to review these Terms periodically.

3 Eligibility and Accounts

The Service is available to users of all ages; however, users under the age of 13 must have verifiable parental or guardian consent before using the Service. Users between 13 and 18 years of age should review these Terms with a parent or guardian.

You are responsible for: (a) maintaining the confidentiality of your account credentials; (b) all activity that occurs under your account; and (c) notifying us promptly if you suspect unauthorized access to your account. Xylingo is not liable for any loss or damage arising from your failure to safeguard your login information.

4 Permitted Use and User Conduct

Xylingo grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial language learning purposes, subject to these Terms.

You agree NOT to:

Use the Service for any unlawful purpose.
Attempt to reverse-engineer or decompile platform code.
Use automated tools, bots, or scrapers without consent.
Distribute malware, spam, or malicious code.
Harass, threaten, or harm other users.
Circumvent technical protection measures.
Resell or commercially exploit the Service.
Impersonate Xylingo employees or other users.

Xylingo makes no representations about the nature of vocabulary or language content accessible through the Service. Human language includes words and expressions that some individuals may find inappropriate. Access to authentic language is not filtered by content rating.

5 AI-Generated Content — Disclaimer and Limitations

We are proud of the AI-powered features at the heart of Xylingo — from adaptive contextual chats to personalized news feeds and native-speaker phrasing suggestions. We invest significant effort in making these features accurate, helpful, and safe. That said, AI systems are inherently imperfect.

AI-generated content may be inaccurate, incomplete, or culturally inappropriate. It should not be treated as authoritative guidance on grammar, vocabulary, or professional matters.

Xylingo does not warrant that AI-generated content will always be appropriate for every context, audience, or background.

Xylingo is NOT responsible for any decisions, actions, or consequences arising from your reliance on AI-generated content.

6 User-Submitted Content

You retain ownership of any content you submit to the Service. By submitting content, you grant Xylingo a worldwide, royalty-free, non-exclusive license to use, process, store, and display that content solely as necessary to provide and improve the Service.

You represent and warrant that you own or have the rights to submit the content and that it does not infringe on any third-party rights. Xylingo reserves the right to remove content that violates these Terms.

7 Subscriptions, Payments, and Refunds

Billing

Fees are billed in advance on a recurring basis. You authorize recurring charges to your designated payment method.

Cancellation

You may cancel at any time. Your access remains active until the end of the current paid billing period.

All payments are generally non-refundable except where required by law. Price changes will be notified at least 30 days in advance.

8 Intellectual Property

All rights, title, and interest in and to the Service — including software, design, trademarks, and proprietary AI models — remain the exclusive property of Xylingo. "Xylingo" and its associated logos are trademarks and may not be used without permission.

9 Privacy

Your privacy matters to us. Our Privacy Policy explains how we collect and protect your data. By using Xylingo, you agree to our Privacy Policy.

10 Geographic Restrictions

Xylingo does not permit access from jurisdictions subject to international sanctions (e.g., Iran, North Korea, Cuba, Syria, etc.). By using the Service, you represent that you are not located in a sanctioned territory.

11 Disclaimers of Warranty

We strive to deliver an excellent experience and stand behind the quality of Xylingo. However, to the fullest extent permitted by applicable law, the Service is provided "AS IS" and "AS AVAILABLE" without any warranty of any kind, express or implied.

12 Limitation of Liability

To the maximum extent permitted by applicable law, Xylingo and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill. In no event shall our total liability exceed the greater of USD $50 or the amount you paid us in the past twelve months.

13 Indemnification

You agree to defend, indemnify, and hold harmless Xylingo from and against any claims, damages, obligations, losses, liabilities, costs, or debt arising from your use of the Service or your violation of these Terms.

14 Service Availability and Modifications

We continuously improve Xylingo and may modify, suspend, or discontinue any part of the Service at any time. We are not liable for any such changes or for any service downtime, whether planned or unplanned.

15 Termination

You may stop using the Service and delete your account at any time. We reserve the right to suspend or terminate your access if we reasonably believe you have violated these Terms or engaged in harmful conduct.

16 Governing Law

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which Xylingo is registered. Any disputes shall first be attempted to be resolved through good-faith negotiation.

17 General Provisions

These Terms, along with our Privacy Policy, constitute the entire agreement between you and Xylingo. If any provision is found to be unenforceable, the remaining provisions will continue in full force and effect.
